Selling a home to avoid foreclosure is only one of the seven most common ways to stop a foreclosure action. You may be able to keep your home if you can prove to your lender that you’re situation was only temporary. Regardless of your situation, the first step in stopping an impending foreclosure is to understand what your options are.
1. Refinance
To be a good candidate for a refinance you should have a substantial amount of equity in your property (typically a minimum of 25%-30%). And the sooner you refinance (assuming it makes good financial sense) the better. The longer you go without making a payment, the greater the impact on your credit, and the harder it will be to qualify for a new loan.
2. Sell the Property
Selling is another option to stop foreclosure. This is not always a realistic option however since you must be able to sell fast enough to avoid foreclosure and for a high enough price to pay off the mortgage (and all other cost associated with the sale).
3. Short Sale
Here again, you’re selling the property. But in this case you’re selling the property for less than what you actually owe on the property. A “short sale” can only be done with the approval of the lender and typically involves selling to an experienced investor with a thorough knowledge of how a short sale is conducted. If the lender agrees to a “short sale”, it typically requires that the borrower not receive any cash proceeds from the sale.
4. Repayment Plan / AKA Special Forbearance Plan
The repayment plan is an option made available to those who can prove that the reason for their payments being late was a temporary one. If you can indeed prove to the lender that your late payments were the result of a “temporary hardship” that has since been resolved, they may allow you to continue making your regular mortgage payment and add an additional dollar amount on top of that each month to make up for the amount you are behind.
5. Loan Modification
A “loan modification” is an agreement with your lender that permanently changes the terms of your original mortgage agreement (i.e., from ARM to fixed, or from 15 year amortization to 30 year amortization) in order to bring your loan current and make the terms more affordable to you. Most lenders will require that you pay a minimum of your past due amount (usually at least 25%) before approving a loan modification.
6. Partial Claim
This is an option only available on FHA insured loans. In simplest terms, HUD (Dept. Housing and Urban Development) agrees to make a new loan for the amount you are behind. It is currently a zero interest loan (but HUD reserves the right to charge interest in the future). And no principal payments are required to be paid until you pay off your first mortgage or sell the property. This option is not available if your first mortgage is already in the foreclosure process.
7. Deed-in-Lieu
This is an option where the borrower deeds the property to the lender as full satisfaction for the mortgage amount owed. The lender can refuse to accept a “deed-in-lieu” and often does since they stand to incur certain cost in the form of holding cost, repairs and real estate commissions if they do take the property as settlement for the loan. They are also subject to inherit any potential title problems you may have as well.
Bankruptcy is another option but it is usually just a temporary “stop gap” measure that simply compounds the problem. More often than not, those who file bankruptcy in an attempt to stop foreclosure find themselves facing foreclosure again within a short period of time.
Regardless of how the situation came about, the worst thing you could do when facing foreclosure is to “do nothing”. The end result in such cases is always the same.
The lender follows through with foreclosure proceedings and the property is auctioned off at the courthouse steps. The Sheriff shows up at the front door with an “eviction notice” and escorts the “previous owner” from the house as all their personal items are removed and put to the curb.
Don’t let that happen to you.
The first step toward stopping foreclosure is to know and understand what your options are. Learn your options and then put a plan into action to remedy the situation in a manner that will do the least amount of damage possible to your credit and your future.

When you are delinquent on your mortgage, especially to the point of foreclosure, this information becomes public knowledge. Some buyers, namely professional investors, seek out those in trouble. Although having a stranger appear at your door or call offering to buy your home may be rude, it is a decision that you may want to give serious thought to.
Another option that you, as a homeowner, has during foreclosure to hire the services of an attorney. When doing so, see those with specialties in foreclosures or real estate. A lawyer can advise you on what steps to take. They can help you understand the pros and cons of pre-foreclosure sales. In some states, attorneys can use bankruptcy as a tactic to stop the foreclosure proceeding. Although not a long-term fix, it may buy you more time to make a decision. It is important to note that bankruptcy, by itself has a whole list of pros and cons.
Most states have what are known as redemption period laws. These are designed to protect homeowners. They give you a grace period to reclaim your home. If you can make good on your mortgage payment, the foreclosure proceedings will stop. States that have these laws often enable you to reclaim your property even after it has been sold at a foreclosure auction. This is provided that you act within the allotted time frame.
If you reside in a state where you are not given a grace period or a redemption period, you always have the option of buying your home again. Anyone can place a bid at a foreclosure auction. With that in mind, placing a bid and being the winning bidder are two different things. It often takes a significant amount of cash to reclaim your home. Your financial lender will also likely attend waiting to pounce. If the bids are not high enough, they will buy your home themselves. This is done to minimize their money lost. Foreclosure is a financial and legal issue. If you attack the issue from a financial standpoint, you must to have cash to pay your mortgage. If you attack it from a legal standpoint, you must be able to find a flaw in the foreclosure lawsuit to dismiss it. I don’t see any other way of stopping foreclosure.
If you are facing foreclosure at this moment, you are inundated by letters from foreclosure assistance companies that charge outrageous amounts of money to negotiate with your lender; the majority of these companies are a scam.
You also get creative letters from so-called “investors” offering free advice and with the intention to make you sell your home to them at a deep discount using deceptive kitchen table closings in which they make you sign mysterious paperwork (land trusts, etc) that basically transfer the title/deed of your home to them sometime taking over your mortgage payments and leaving the loan liability on your name. Some of this “investors” also offer very deceptive “lease-back” arrangements in which they let you stay in your home as a tenant, and they pray that you stop paying rent so that they can evict you so that they can take possession of your house. You also get letters from Realtors® who are trying to make you list your home for sale and paint a rosy picture of the real estate market and the value of your home (Read National Consumer Law Center’s report “Dreams Foreclosed;” one of the best studies recently written about the rampant theft of American’s homes through equity-stripping foreclosure rescue scams).
Last but not least dangerous, you get letters from nice attorneys offering free consultations to make you file Chapter 13 bankruptcy; what these attorneys don’t tell you is that based on research (see studies: The Realities of U.S. Personal Bankruptcy under Chapter 13, and Chapter 13 Bankruptcy: Successful Versus Unsuccessful Debtors) the overwhelming majority of Chapter 13 filers do not complete their payment plans and are not discharged.
You will also find on the internet a proliferation of eBooks that promise to stop foreclosure magically with names such as “Foreclosure Free Zone,” “The Fight Of Your Life: How To Beat The Foreclosure Demons Smart Solutions For Saving Your Home,” “Avoid Foreclosure And Fix Credit Problems,” ”Foreclosure Help – Don’t Let The Bank Take Your Home!“ In my research, I’ve even bought some of these type of eBooks just to see what’s so magical about them, and found that they don’t have any information that isn’t common sense and readily available for free online. All the advice in these books fall into these categories: 1) Talk to your lender, 2) Sell your home, 3) File for Chapter 13 bankruptcy protection, and 4) Refinance/Get a loan. None of these books, nor the Chapter 13 attorney, nor the Realtors®, nor the “investors” in their white horses tell you about your legal rights and how you can defend yourself from the abuse of the debt collector attorneys.
Foreclosure is a financial and legal issue. If you attack the issue from a financial standpoint, you must to have cash to pay your mortgage regardless of negotiating a payment plan with your lender yourself or through a foreclosure assistance/consulting company. Bear in mind that when negotiating a payment plan with your lender (sometimes called Forbearance Agreement) , you may be required to come up with a lump sum (usually half of your past-due payments) and proof of income. It’s very simple; if you have sufficient cash and/or income to pay your monthly mortgage obligation, it’s very likely you can negotiate something with your lender to stop foreclosure. If you don’t have the cash and/or the income, you will have to attack the issue from a legal standpoint.
If you attack the issue from a legal standpoint, you must learn about your legal rights and, preferably with the help of a consumer protection attorney (www.naca.net), find a technical or legal flaw in the lawsuit to have it dismissed. These flaws could be hidden in the lender’s debt collection attorney not following your state’s rules of civil procedures (for instance: You were served improperly) or by digging into the foreclosure complaint and court docket to see if there is an actual plaintiff’s proof of ownership of the promissory note, or if the original promissory note has been filed in the court records, or any of the other twenty-something reasons that that could render a judgment void or invalid.
There is no magic in foreclosure. If a homeowner doesn’t pay his or her mortgage, the lender will foreclose on their homes. There is no magical negotiation with a lender that can be done without cash at hand and/or ability to pay supported by proof of income. There is a lot of literature on the internet and in bookstores about the debt collection industry, on how to stop foreclosure negotiating with the mortgage lenders, about how debt collections works, about what to expect from debt collectors, etc, etc. However there is little information about how to navigate the legal system, on how to file pleadings and motions and on how to execute the steps necessary to win the debt collection/foreclosure battle in court. Almost nobody explains to homeowners in simple terms how the legal system works and how they can use it to your advantage to win debt collection lawsuits.

Foreclosure occurs when a borrower fails to make payments on his or her mortgage. The lender then obtains a court order to repossess the property and sell it to recoup the mortgage.
Types of Foreclosure
There are several types of foreclosure. Judicial foreclosure and foreclosure by power of sale are the two most common. In judicial foreclosure, the residents must move out of the home in a specified period of time. The sale of the mortgaged property is then conducted under the supervision of a court. When the home is sold, the proceeds are first used to pay back the first mortgage. Any remaining proceeds will go to other lien holders and then finally the borrower, if anything is left.
With foreclosure by power of sale, the lender can sell the home without the supervision of the court. A “power of sale” clause, however, is usually required in the mortgage contract in order for this type of foreclosure to occur. In addition, this type of foreclosure does not provide the lender with a deficiency judgment. This makes it difficult to obtain title insurance for the property. Like a judicial foreclosure, once the home is sold, proceeds must first go to pay off the mortgage and any other lien holders.
While these are the two most common types of foreclosure, there are also other types of foreclosure. Since foreclosure laws can vary in each state, if you are facing foreclosure, it is best to obtain legal advice in your area.
How to Avoid Foreclosure
If you can no longer meet your mortgage payments, do not be embarrased. The first step is to contact your lender. Your lender may be open to some of the following options:
Forebearance: Lenders may be willing to postpone taking legal action against you and let you work out a repayment plan that is feasible for you.
Repayment Plan: Lenders may let you spread out the missed payments over a longer period of time. You would pay a little extra in your future payments to make up for those that were missed.
Note Modification: Lenders may change the parameters of your loan. For example, they may freeze your rate on an adjustable loan. They could also extend the term of your loan.
Refinance: The lender may add the missed payments back on to the balance of the loan. This is only available if you have sufficient equity and meeting lending requirements.
Debt Forgiveness The lender might waive your obligation on some of your missed payments. This, however, rarely happens.
How to Stop Foreclosure
Sell Your Home: Sell your home and use the proceeds to pay off the mortgage.
Short Sale: If your home is worth less than your mortgage, talk to you lender about a short sale. In a short sale, the lender agrees to selling the home at market value and forgiving the remainder of the loan. A short sale affects your credit but not as bad as a foreclosure.
Deed-in-Lieu of Foreclosure: In this scenario, the lender signs over the property’s deed to the lender in exchange for closing the loan. Deed-in-lieu of foreclosure, however, affects your credit the same as foreclosure.

There are many ways to avoid and stop foreclosure.

The bill could help over 600,000 people stop the foreclosure process by allowing them to file for bankruptcy, and then the bankruptcy judge has the option to modify the home owner’s loan. There are many stipulations to this law and who qualifies. Not always is the home owner going to be able to save their house from foreclosure this way.

Most homeowners believe that foreclosure laws are designed to hurt rather than help them. Not so. The secret is that foreclosure laws have evolved to protect the borrower–not the lender. There, I’ve said it. The secret is out! Now listen closely and understand why I say this. The foreclosure process gives you, the borrower, specific periods of time in which to:
• bring your loan current by making up the missed payments (known as “reinstatement”), or
• pay off your loan in its entirety (called “redemption”).
If neither of these options is feasible, you will still have time to prevent your property from being sold at a public auction (the foreclosure sale).
You will get the most benefit out of the foreclosure process if you envision this secret as a “window of opportunity” to resolve your financial problems. During this window of opportunity, you have time to learn about the foreclosure process and implement a strategy to stop the foreclosure.
Another basic misconception about foreclosure is that lenders want to foreclose. Nothing could be further from the truth! Lenders are in the business of loaning money–not owning real estate.
They don’t want your house back for numerous reasons. Lenders are reluctant to incur the costs of a foreclosure. For example, if your lender is forced to foreclose, it will not only lose your back payments, but it will also incur foreclosure expenses, taxes, insurance, wear and tear while you (or your tenant) live in the
property, repair costs to refurbish the property for sale, and a real estate agent’s commission once the property is sold. As a result, many lenders will go out of their way to work out a resolution–short of actually foreclosing–if you give them the opportunity.
A. Communicate With Your Lender
The secret to stopping your foreclosure is communicating with your lender. With the sudden avalanche of foreclosures and defaults, lenders are more eager than ever before to workout a solution rather than foreclosing. Lenders will do almost anything to avoid increasing their overflowing REO inventory of foreclosed properties.
Don’t shy away because you’ve missed payments, concerned that you will miss some payments in the future, or that your property has already gone into foreclosure. Whether you communicate by telephone, letter, email, fax, or in person, you will have a much easier time stopping (or at the very least, delaying) the foreclosure if you talk to your lender rather than adopting a code of silence.
The secret is to negotiate directly with someone with “authority” at your lender’s office. The first step is to determine who your lender actually is. (This is no small feat these days with lenders selling their loans to other lenders like hot potatoes.) If your property has already gone into foreclosure, the first person you will be dealing with will either be the foreclosing trustee, or the attorney for the lender. If it is a judicial foreclosure, you will most likely be contacted by a process server, sent by the lender’s attorney. If it is a non-judicial foreclosure, the trustee is responsible for handling the foreclosure process. You will need to contact these people.
But the secret is that you will be more successful if you communicate directly with your lender, rather than the trustee or the attorney. So you should request from the trustee or the attorney, the name, telephone number, and address of the foreclosing lender. In the unlikely event that they refuse to disclose the name of your lender, you can look on the Notice of Default, or the summons and complaint, or telephone the customer service department of a local title insurance company.
Another situation may occur where you discover the name of your lender, but it turns out to be a servicing agent rather than the party that actually holds the deed of trust or mortgage. A servicing agent is a company (sometimes it can be a bank, mortgage company, or private corporation) that is hired by the actual lender to “service” the loan, (issuing mortgage statements, payment coupons and late notices, collecting payments, monitoring the impounding of insurance and tax payments, and handling foreclosures if necessary). Fortunately, most servicing agents will disclose the name of the lender. If they won’t, you may be forced to negotiate with the servicing agent.
In the interim, you will receive threatening calls from collection agents at the lender’s office. Do not under any circumstance ignore your lender’s contacts. Your goal should be to respond to every phone call or letter. Difficult as it may be to talk about your financial problems, be polite and cooperative. Follow up all telephone calls with a letter to the person you spoke to, confirming what was said. If you’re not in when a call comes, return it as soon as you can. Use these calls to collect information regarding your lender (i.e. lender’s name, address, phone number, fax number, email address, responsible department or individual).
When you receive a letter from your lender (always keep the original), immediately write a letter in response. The secret here is to establish a paper trail so you can prove to your lender (or a court, if necessary) that you have been cooperative, especially during the initial stages of the foreclosure process.
It is also important to send copies of all of your letters to:
• the lender’s CEO
• the branch manager (if applicable)
• the loan officer who helped you obtain your loan, and
• any other person you know by name at your lender’s office.
B. CONTACTING PEOPLE YOU KNOW AT THE LENDER’S OFFICE
Make sure your letter indicates you are sending copies by typing “cc:” and the name of the person(s) below your signature. Please don’t be hesitant to send copies of your letters to these individuals, as they can’t do anything to help you if they aren’t aware of your predicament. There is a secret to sending copies to other people and showing the “cc” at the bottom of your letters. At the very least, the person you sent the letter to won’t be able to ignore your letter because he or she knows that supervisors have received copies.
Typically, in their initial letters and telephone calls, your lender will state that they have not received your payment(s) and inquire innocently whether or not you have mailed a payment. What you say in response to your lender’s inquiry is another matter. If you already mailed your payment, give your lender the date. If you have not, tell the truth. Your lender in turn will want to know why you haven’t paid, and what date you will be sending a payment. Acknowledge that you are having temporary financial problems and that you won’t be able to make the payments for the next couple of months. Provide a good explanation of your financial difficulties (i.e. layoff, medical emergency, death in the family, loss of business, divorce). Contrary to popular belief, sharing this information will not speed up the foreclosure process. What you say may make the lender more sympathetic to your situation and may delay the foreclosure. At the very least, it will foster a positive atmosphere for negotiations later in the process.
Your lender may warn you that if payments are not made, your loan will go into default. It may also threaten to start foreclosure proceedings unless you bring all of your payments current immediately. Don’t be intimidated. Stay calm and understand that the person you’re dealing with is simply doing his job. At this point, write a letter explaining your financial problem and request an appointment with a senior loan officer to discuss your loan.
